Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Equalus mobile application and related services (together, the “Service”), provided by Madwilliker, LLC (“Madwilliker,” “we,” “us,” or “our”). By downloading, accessing, or using Equalus, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding contract to use the Service. Equalus is intended for adults managing a household.

2. Your account

Equalus creates an account for your device so your data can sync. You may optionally add an email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorised use.

3. Households & partners

Equalus lets you create a household and invite one or more partners to collaborate. Content within a household — including tasks, effort ratings, schedules, completion history, names, and balance information — is visible to all members of that household. You are responsible for who you invite and for the information you choose to share. Only invite people you trust and intend to share household information with.

You retain ownership of the content you create in Equalus, such as tasks, notes, and household details (“Your Content”). You grant us a limited, non-exclusive licence to host, store, process, and display Your Content solely to operate and provide the Service to you and your household members. You are responsible for Your Content and for ensuring you have the right to submit it.

6. Our intellectual property

The Service, including its software, design, branding, and the “Equalus” name and logo, is owned by us and protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, no other rights are granted. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

7. Third-party services

The Service relies on third-party providers, including Google Firebase (authentication, database, and cloud functions), Resend (email delivery), RevenueCat (subscription management), and PostHog (product analytics). Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for third-party services we do not control.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any balance calculations, insights, or data will be accurate or suitable for any particular decision. Equalus is a tool to support fair collaboration; it is not a substitute for professional, legal, financial, or relationship advice.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $25. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Termination

You may stop using the Service and delete your account or household at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

13. Apple App Store terms

If you download Equalus from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide support or maintenance for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the Service must also comply with the Apple Media Services Terms and Conditions.

14. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the state and federal courts located in the State of Georgia, unless mandatory local consumer law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
